Nursing Homes

All nursing homes have the obligation to properly assess the health and needs of each resident and to implement and follow a care plan. If an injury occurs, it’s important to determine whether it was due to the failure of the nursing home to comply with legally required levels of care. If an injury is the result of a long-term pattern of substandard care, it could give rise to a significant claim.

Nursing Home Negligence

  • Attention
  • Inadequate staff
  • Inadequate training
  • Inadequate equipment

A nursing home may be negligent if…
--the home failed to pay attention to the needs of a resident
--there weren’t enough staff members to meet residents’ needs
--the staff wasn’t properly trained to deal with a resident’s needs
--the home lacked the proper equipment to provide safe care

Accidents happen, and a nursing home can’t prevent every fall. But, it does have the legal and moral duty to take all reasonable actions to prevent accidents and will be liable for failing to do so. In the event of a nursing home injury, talk with an attorney to determine if there is enough evidence for a claim.
